Terms of Service
Terms for Didymoi / Didymoi Cloud software, APIs, subscriptions, Usage Credits, and payments
1. Operator, scope, and eligibility
Didymoi / Didymoi Cloud is a software and online-services brand independently operated by its developer (“Didymoi,” “we,” “us,” or “our”) and is not currently a separate legal entity. These Terms apply to the account center, Didymoi-owned software, APIs, model inference, report generation, membership subscriptions, Usage Credit Pack purchases, and related services.
By accessing, registering for, purchasing, subscribing to, or using the services, you agree to these Terms. You must be at least 18 years old and legally capable of entering into these Terms; if the law where you live requires a higher age, that higher age applies.
If you use the services on behalf of a company or organization, you confirm that you have authority to accept these terms on its behalf.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and non-sublicensable right to lawfully use services that you have purchased or are authorized to access during the applicable service period and within the authorized scope. This right may be suspended or terminated only under the suspension, termination, and refund provisions of these Terms. We reserve all rights not expressly granted in these Terms.
Before registering, purchasing, subscribing, or calling an API, please read these Terms, the Privacy Policy, and the Refund Policy in full. Pay particular attention to automatic renewal, cancellation, liability limits, Usage Credit validity, service suspension, and disputes.
2. Accounts and security
You must provide accurate account information and are responsible for securing your account, password, OAuth login methods, API keys, and session credentials.
Unless mandatory law provides otherwise, you are responsible for Usage Credit consumption or data changes caused by account sharing, credential leakage, third-party devices, or network environments under your control.
API keys, OAuth client secrets, and refresh tokens must not be published, forwarded, committed to a repository, or embedded in browser code. If you discover a leak, abnormal usage, or unauthorized access, revoke or rotate the credential immediately and contact us.
3. Usage Credits
Usage Credits are service-specific entitlements that provide prepaid access to Didymoi-owned software, API calls, model inference, token usage, report generation, and related compute resources. Credits are deducted as those services are used.
Usage Credits are not cash, electronic money, stored value, gift cards, vouchers, or redeemable monetary value. They cannot be withdrawn, transferred, exchanged for cash, or used for third-party platforms, goods, or services outside Didymoi.
Usage Credit deductions are based on server records. Where retries, duplicate requests, client display delays, or connected Didymoi application records differ, the server-side order and usage history are authoritative.
4. Credit-pack purchases, issuance, and validity
After you choose a Usage Credit Pack and complete payment, the order is confirmed by payment provider events. Usage Credits are issued only after our server receives and successfully processes the provider event; the browser return page only displays status.
Purchased Usage Credits are valid for 90 days from issuance. Unused credits expire after the validity period unless we confirm a technical error or mandatory law requires otherwise.
Usage Credit Packs are one-time purchases and do not renew automatically. Unless the order page clearly says otherwise, we will not initiate later charges to your payment method.
An order may move through pending, paid, issued, refunded, chargeback, or dispute states. A browser return result is not the final server confirmation, and duplicate provider events do not issue units twice.
5. Subscriptions and automatic renewal
Subscription plans provide continuing service entitlements on the monthly or yearly cycle shown at checkout. Your payment method is charged immediately at the selected price.
Subscriptions renew automatically on the original billing cycle until canceled. You authorize the collecting party identified at checkout to charge the registered payment method on each renewal date for the subscription price, applicable taxes, and any other charges clearly disclosed at checkout.
You may cancel using the management link in your subscription confirmation email or receipt, or by contacting us through the Contact page. Cancellation normally takes effect at the end of the current billing period, and you may continue using paid-period entitlements until then.
After the first successful subscription payment, the account receives a one-time grant of 300 credits. The initial grant, monthly subscription grants, and upgrade-adjustment grants are each valid for 90 days from their respective issuance dates. Monthly credits for yearly plans are still issued monthly. Cancellation does not remove issued credits early or extend their original validity.
If payment fails, the collecting party may retry the charge as permitted by law, and the subscription may enter a past-due, grace-period, paused, or canceled state. We update access and credit grants from payment events and provide notices or an opportunity to cure where required by applicable law.
If a subscription price changes, we or the collecting party will provide notice within the period required by applicable law and obtain consent where required. A price change will not retroactively alter a billing period that has already begun.
6. Payments, taxes, and invoices
Didymoi may offer checkout through one or more payment channels. Payments may be handled by an authorized payment provider, acquirer, non-exclusive reseller, or Merchant of Record. The seller, payment channel, price, currency, taxes, renewal terms, and applicable terms for each transaction are those identified at checkout, in the order confirmation, and on the receipt.
We may designate payment channels by product, territory, time, and operational arrangement. Not every channel is offered simultaneously, and customers may not be able to choose the payment provider. New transactions use the channel shown at checkout, while existing subscriptions, refunds, chargebacks, disputes, and historical orders remain handled by the channel and seller identified for the original transaction within their respective roles.
For orders processed through Paddle, our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for those orders and handles payment processing, applicable sales taxes, billing support, and returns or refunds. Didymoi remains responsible for product delivery, account entitlements, and technical support. Paddle's Buyer Terms also apply: https://www.paddle.com/legal/buyer-terms.
For a transaction processed through standard Stripe Payments where checkout does not identify Stripe or an affiliated service as the seller or Merchant of Record, Didymoi or another party identified at checkout is the seller and remains responsible, to the extent required by applicable law, for the relevant sales obligations, taxes, invoices, and refund decisions. Stripe and its affiliates act only within their role in payment processing, identity verification, fraud prevention, billing, and refund settlement. Stripe's Privacy Policy applies to Stripe's processing of relevant information: https://stripe.com/privacy.
If checkout expressly identifies Stripe Managed Payments, a Stripe-affiliated Merchant of Record, or another Merchant of Record service as selling or handling the transaction, the party and buyer terms identified at checkout, in the order confirmation, and on the receipt apply. Payment methods, taxes, receipts, invoices, billing, and refunds for any other channel are likewise governed by the checkout disclosures, order confirmation, and applicable channel terms.
7. Refunds and disputes
Refunds, chargebacks, and disputes are governed by our Refund Policy. Usage Credits that have been issued and used are generally non-refundable, but these terms do not limit any mandatory consumer rights under applicable law.
Refunds, chargebacks, or disputes initiated through a payment provider may result in corresponding Usage Credits being revoked, frozen, or adjusted.
If Paddle is the seller for the relevant transaction, Paddle's Buyer Terms (https://www.paddle.com/legal/buyer-terms) and Refund Policy (https://www.paddle.com/legal/refund-policy) also govern payment, taxes, cancellation, billing, and refund processing.
For a standard Stripe Payments transaction, Didymoi or another seller identified at checkout determines refund eligibility and related disputes, while Stripe and relevant financial institutions execute refunds, risk controls, chargebacks, and settlement within their respective roles. If checkout identifies a Stripe-affiliated entity as the seller, reseller, or Merchant of Record, that entity's buyer, refund, and dispute terms identified at checkout, in the order confirmation, or on the receipt apply.
If another party identified at checkout is the seller, reseller, or Merchant of Record, its buyer, refund, and dispute terms identified at checkout, in the order confirmation, or on the receipt also apply. Within the relevant party's role, the channel terms applicable to that transaction and any non-waivable consumer rights control if they conflict with these Terms.
8. Prohibited use
You must not use the services for unlawful, fraudulent, infringing, abusive, attacking, billing-circumvention, API-abuse, service-disruption, risk-control-evasion, or otherwise prohibited purposes.
If we reasonably believe there is abnormal activity, abuse, attack, fraud, or legal risk, we may suspend, limit, terminate services, or adjust related Usage Credits.
You must not use the services to generate, distribute, or assist with false, misleading, unlawful, or rights-infringing content. Where law or platform rules require labeling of AI-generated content, you must provide a clear notice when publishing or sharing it.
You must not bypass authentication, access controls, rate limits, billing rules, or security checks; scan, load-test, reverse-proxy, scrape, resell, or share service access unless we authorize it in writing.
9. Input, output, and intellectual property
You must have all rights, licenses, and permissions needed for any inputs, files, prompts, or other content you submit. You must not infringe another person's privacy, intellectual property, or other legal rights.
As between you and Didymoi, you retain rights in your inputs and, to the extent such rights can arise under applicable law, own the output generated for you. Output may not qualify for intellectual-property protection and may be identical or similar to output generated for other users.
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, transform, and process your inputs and outputs only for as long as reasonably necessary to provide, maintain, protect, and troubleshoot the services or comply with law. We and model or infrastructure providers needed to deliver the services process this content under the Privacy Policy and their applicable data-processing terms.
Service output may be inaccurate or incomplete. You must review output before using or publishing it and must not treat it as professional advice or the sole source of truth.
The services, software, interfaces, trademarks, and related technology belong to Didymoi or its licensors. You may not copy, reverse engineer, resell, or bypass technical limits unless permitted by law or written authorization.
If you believe content in the services infringes your intellectual property or other legal rights, submit supporting evidence, the location of the content, and your requested remedy through the Contact page. We will take appropriate action after necessary verification.
10. Service changes and availability
We may change features, subscription plans, prices, Usage Credit Packs, validity periods, or billing rules for security, operations, product, or compliance reasons. Changes to subscription prices or other material terms will be notified as required by applicable law and the subscription rules in these Terms.
Unless applicable law requires otherwise, it is strictly necessary to address a confirmed fraud or security incident, or you explicitly agree to different treatment, changes to Usage Credit validity, pricing, or billing rules apply only to items purchased, renewed, or issued after the change takes effect and will not retroactively shorten the original validity of Usage Credits already purchased or issued.
Services may be interrupted or delayed due to maintenance, third-party services, networks, force majeure, or security incidents. We will make reasonable efforts to restore service.
For planned maintenance, we will provide advance notice where reasonably practicable. Emergency security fixes, legal requirements, or unforeseen events may require changes without advance notice.
You may stop using the services and request account deletion under the Privacy Policy. We may suspend or terminate services for a material breach of these Terms, fraud or security risk, legal requirements, or where continued provision is no longer reasonably practicable. We will provide notice or an opportunity to cure where required by applicable law.
When service ends because of user breach, fraud, abuse, chargeback, or legal requirements, account data, unused credits, paid subscriptions, and refunds are handled under these Terms, the Refund Policy, buyer terms presented at checkout, and mandatory law.
If Didymoi permanently discontinues a relevant paid service for its own operational reasons and the user has not engaged in the breach, fraud, or abuse described above, we will, where reasonably practicable, provide a continued-use period, migration, a substitute service, or an appropriate remedy for the unperformed portion. Any return of funds is processed by the seller or payment provider identified on the order under its procedures and applicable law.
11. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, the services are provided as-is and as-available. We do not promise that the services will be continuous, error-free, fully accurate, or free from data loss, and we are not liable for indirect, incidental, special, punitive, exemplary, or consequential damages.
Unless mandatory law provides otherwise, our aggregate liability relating to your use of the services will not exceed the greater of the amount actually paid for the order giving rise to the dispute or the amount you actually paid for the relevant services during the 12 months before the dispute arose.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence where such liability cannot lawfully be limited, or any other liability that applicable law prohibits us from excluding or limiting.
12. Disputes and severability
If a dispute arises, contact us first using the email listed on the Contact page so that we can try to resolve it within a reasonable period. Payment, tax, billing, cancellation, refund, and other disputes involving Paddle or another seller, reseller, or Merchant of Record identified at checkout are also subject to that party's buyer terms and dispute process identified at checkout, in the order confirmation, or on the receipt.
These Terms do not limit mandatory consumer rights under applicable law or prevent either party from seeking relief before a court or authority that has jurisdiction under applicable law. If any part of these Terms is held invalid or unenforceable, the remaining parts remain effective.
13. Updates and contact
We may update these Terms as our services, payment arrangements, laws, or security requirements change. Updated Terms will be posted on this page with a new effective date. If a change materially affects existing users' rights or obligations, we will provide notice in the time and manner required by applicable law.

These Terms, the Privacy Policy, the Refund Policy, and related legal notices may be provided in multiple languages. Unless applicable law requires another version to control, the English version controls if versions conflict. This interpretation rule does not limit non-waivable consumer or data-protection rights.
14. Customer data and privacy obligations
If you process end-user data for an organization through an API, OAuth application, or other integration, you must ensure that the data has a lawful source, legal basis, necessary authorization, and appropriate privacy notice. You are responsible for complying with applicable data-protection, content-safety, and sector-specific requirements.
For end-user data where you or your organization determines the purposes and means of processing, you or your organization is the relevant data controller. Where applicable, Didymoi processes that data as a processor or service provider only on your instructions and as needed to provide the API, OAuth, or integration functionality you request.
If applicable law requires a Data Processing Addendum (DPA) or another written arrangement before end-user personal data is submitted, you must contact us first to confirm whether such terms are available and complete the agreement. Until it is completed, you must not use the services for personal data that legally requires those written processor terms. You are responsible for deciding how to back up, export, and delete data. Unless separately agreed in writing, we do not provide an enterprise SLA, data-deletion certificate, or data-recovery guarantee.
If we reasonably believe that customer data, an application, or a usage pattern presents a security, legal, infringement, or abuse risk, we may take minimally necessary steps to limit, suspend, delete, preserve evidence, or cooperate with authorities, and will explain the reason where law permits.
15. Confidentiality, business transfer, third-party claims, and survival
Each party must use reasonable care to protect non-public business, technical, security, and account information obtained through the services. This does not prevent disclosures required by law, needed to provide the services to necessary processors, or concerning information already lawfully public.
If Didymoi is later operated by a newly formed company, an affiliated business operator, or a lawful successor to the service, we may transfer the business-related rights and obligations under these Terms to that operator and provide notice as required by applicable law. The transfer will not reduce mandatory consumer rights you have already acquired.
To the extent permitted by law, if you use the services on behalf of a business, you are responsible for third-party claims directly caused by your unlawful inputs, infringement of third-party rights, or material breach of these Terms. This does not apply to the extent a claim is caused by our fault and does not expand a consumer's liability under applicable law.
Provisions concerning payments, refunds, intellectual property, confidentiality, liability, disputes, and legally required data retention may survive termination to the extent permitted by their nature and applicable law.
1. 运营者、适用范围与资格
Didymoi / Didymoi Cloud 是由独立开发者运营的软件及在线服务品牌(以下简称“Didymoi”“我们”或“本服务提供者”),目前并非独立法人实体。本服务条款适用于 Didymoi 提供的账号中心、自有软件、API、模型推理、报告生成、会员订阅、使用积分包购买及相关服务。
访问、注册、登录、购买、订阅或使用我们的服务,即表示你同意遵守本条款。你必须年满 18 周岁并具有订立本条款所需的法律行为能力;如你所在地法律要求更高年龄,以该年龄为准。
如你代表公司或其他组织使用服务,你确认你有权代表该组织接受本条款。
在你遵守本条款的前提下,我们授予你一项有限、非独占、不可转让且不可再许可的权利,仅在适用的服务期限和授权范围内合法使用已购买或获准访问的服务。该权利仅可依照本条款的暂停、终止和退款规则处理;除本条款明确授予的权利外,我们保留对服务的全部权利。
请在注册、购买、订阅或调用服务前完整阅读本条款、隐私政策和退款政策。对自动续费、首次赠送积分、取消、责任限制、使用积分有效期、暂停服务和争议处理等与你权益有重大关系的内容,请特别注意。
2. 账号与安全
你需要提供真实、准确且可联系的账号信息,并负责维护账号、密码、OAuth 登录方式、API Key 及会话凭证的安全。
因账号共享、凭证泄露、第三方设备或网络环境导致的使用积分消耗、数据变更或损失,由账号持有人自行承担,除非法律另有强制规定。
API Key、OAuth 客户端密钥和刷新令牌不得公开、转发、提交到代码仓库或嵌入浏览器端。发现泄露、异常调用或未经授权使用时,应立即撤销、轮换凭证并联系我们。
3. 使用积分定义
使用积分是按 Didymoi 自有软件、API 调用、模型推理、token 消耗、报告生成及相关计算资源计量并扣减的预付数字服务使用单位。
使用积分不是现金、电子货币、储值账户、礼品卡或任何可赎回的货币价值;不可提现、不可转让、不可兑换现金,也不可用于第三方平台或非 Didymoi 自有服务。
使用积分扣减以服务端记录为准。因网络重试、重复请求、客户端展示延迟或关联 Didymoi 应用记录差异产生的显示不一致,应以服务端订单和积分明细为最终依据。
4. 使用积分购买、发放与有效期
用户选择使用积分包并完成付款后,系统会根据支付渠道事件确认订单。积分发放以服务端收到并成功处理渠道事件为准,浏览器支付返回页面仅用于展示状态。
购买的使用积分自发放之日起 90 天有效。过期后未使用的积分会失效,除非平台确认存在技术异常或法律另有要求。
使用积分包属于一次性购买,不会自动续费。除非订单页面另有明确说明,平台不会自动向你的支付方式发起后续扣款。
订单状态可能经历待支付、已支付、已发放、已退款、拒付或争议等阶段。支付页面返回结果不等同于服务端最终确认;重复回调不会重复发放积分。
5. 订阅与自动续费
订阅套餐按结账页面显示的月付或年付周期提供持续服务权益。支付方式将在结账时立即按所选价格扣款。
订阅会按原计费周期自动续费,直至取消。你授权订单页面所示的收款方在每个续费日向已登记的支付方式收取当期订阅费用、适用税费及结账页面明确展示的其他费用。
你可以通过订阅确认邮件或收据中的管理入口取消订阅,也可以通过 Contact 页面联系我们。取消通常在当前计费周期结束时生效;在此之前,你仍可使用已支付周期内的订阅权益。
首次成功订阅付款后,账户将一次性获赠 300 credits。首次赠送积分、每月发放的订阅积分以及升级补发积分,均自各自发放之日起 90 天有效。年付套餐的月度积分仍按月发放;取消订阅不会提前清除已发放积分,也不会延长其原定有效期。
付款失败时,收款方可能依法重试扣款;订阅可能进入付款待处理、宽限、暂停或取消状态。我们会根据支付事件更新访问权限和积分发放,并在适用法律要求时提供通知和补救机会。
如订阅价格发生变化,我们或收款方会在适用法律要求的时间内通知你,并在法律要求时取得同意。价格变化不会追溯修改已经开始的计费周期。
6. 付款、税费与发票
Didymoi 可能通过一个或多个支付渠道提供结账服务。付款可能由我们授权的支付服务商、收单机构、非独家转售商或 Merchant of Record 处理。每笔交易的实际销售方、收款渠道、价格、币种、税费、续费信息及适用条款,以结账页面、订单确认和收据展示的内容为准。
我们可能根据产品、地区、时间和运营安排指定支付渠道,但并非所有渠道都会同时提供,用户也不一定能够自行选择支付服务商。新交易适用结账时显示的渠道;已有订阅、退款、拒付、争议和历史订单仍由原交易所示渠道及销售方按照其职责处理。
对于通过 Paddle 处理的订单,我们的订单流程由在线转售商 Paddle.com 执行。Paddle.com 是这些订单的 Merchant of Record,并负责付款处理、适用销售税、账单支持以及退货或退款事务。Didymoi 负责产品交付、账户权益和技术支持。该交易同时适用 Paddle 买方条款(https://www.paddle.com/legal/buyer-terms)。
对于通过普通 Stripe Payments 完成且结账页面未将 Stripe 或其关联服务列为销售方或 Merchant of Record 的交易,Didymoi 或结账页面列明的其他主体是销售方,并在适用法律要求的范围内负责相关销售义务、税务、发票和退款决定;Stripe 及其关联机构仅在其职责范围内提供支付处理、身份验证、反欺诈、账单和退款结算服务。Stripe 的隐私政策适用于 Stripe 对相关信息的处理:https://stripe.com/privacy。
如果结账页面明确显示交易由 Stripe Managed Payments、Stripe 关联的 Merchant of Record 或其他 Merchant of Record 服务销售或处理,则该页面、订单确认和收据列明的主体及其买方条款适用于该交易。其他渠道的支付方式、税费、收据、发票、账单和退款安排,同样以结账页面、订单确认和该渠道适用条款为准。
7. 退款与争议
退款、拒付和争议处理适用我们的退款政策。使用积分一经发放且被使用,原则上不支持退款;但本条款不限制任何适用法律赋予消费者的强制性权利。
支付渠道发起的退款、拒付或争议事件可能导致相应使用积分被回收、冻结或调整。
如 Paddle 是相关交易的销售方,付款、税费、取消、账单和退款处理还适用 Paddle 买方条款(https://www.paddle.com/legal/buyer-terms)及 Paddle 退款政策(https://www.paddle.com/legal/refund-policy)。
对于普通 Stripe Payments 交易,Didymoi 或结账页面列明的其他销售方负责退款资格和相关争议决定,Stripe 及相关金融机构在其职责范围内执行退款、风控、拒付和资金结算;如结账页面将 Stripe 关联主体列为销售方、转售商或 Merchant of Record,则该主体在结账页面、订单确认或收据中列明的买方、退款及争议条款适用。
如其他结账页面列明的主体是销售方、转售商或 Merchant of Record,则其在结账页面、订单确认或收据中列明的买方、退款及争议条款同样适用。在相关主体的职责范围内发生不一致时,以适用于该笔交易的渠道条款及不可放弃的消费者权利为准。
8. 禁止用途
你不得将服务用于违法、欺诈、侵权、攻击、绕过计费、滥用 API、破坏服务稳定性、规避风控或任何违反平台规则的行为。
如我们合理认为存在异常交易、滥用、攻击、欺诈或违反法律法规的风险,我们可暂停、限制、终止服务或调整相关使用积分。
不得利用服务生成、传播或协助传播虚假、误导、违法或侵犯他人权益的内容;如法律或平台规则要求对人工智能生成内容进行标识,你应在发布或提供给他人时作出清晰说明。
禁止绕过身份认证、访问控制、速率限制、计费规则或安全校验;禁止扫描、压测、反向代理、抓取、转售或共享服务访问权限,除非获得书面授权。
9. 输入、输出与知识产权
你应确保提交给服务的输入、文件、提示词和其他内容具有必要的权利、许可和授权,不得侵犯他人的隐私、知识产权或其他合法权益。
在你与 Didymoi 之间,你保留对输入内容的权利;在适用法律允许相关权利产生的范围内,你拥有为你生成的输出。输出可能不受知识产权法律保护,也可能与其他用户获得的输出相同或相似。
你授予我们一项非独占、全球范围、免许可费的有限许可,仅允许我们在提供、维护、保护和排查服务以及遵守法律所必需的期间托管、复制、传输、转换和处理你的输入与输出。我们及为提供服务所必需的模型或基础设施提供商会依照隐私政策和各自适用的数据处理条款处理该等内容。
服务输出可能不准确或不完整,你应在使用或发布前进行人工核验,不应将其作为专业意见或唯一事实来源。
服务、软件、界面、商标和相关技术归 Didymoi 或其许可方所有;除非法律或书面许可允许,你不得复制、反向工程、转售或绕过技术限制。
如你认为服务中的内容侵犯你的知识产权或其他合法权益,请通过 Contact 页面提交权利证明、侵权内容位置和具体请求;我们会在完成必要核验后采取适当处理措施。
10. 服务变更与可用性
我们可能基于安全、运营、产品迭代或合规原因调整服务功能、订阅套餐、价格、使用积分包、有效期或计费规则。对订阅价格或其他重大内容的调整,会依照适用法律和本条款的订阅规则提供通知。
除非适用法律要求、为处理已经确认的欺诈或安全事件所严格必要,或者你明确同意另行处理,对使用积分有效期、价格或计费规则的变更仅适用于变更生效后购买、续订或发放的项目,不会追溯缩短已经购买或发放的使用积分之原定有效期。
服务可能因维护、第三方服务、网络、不可抗力或安全事件而中断或延迟。我们会尽合理努力恢复服务。
对于计划内维护,我们会在合理可行的范围内提前通知;对于紧急安全修复、法律要求或不可预见事件导致的变更,可能无法提前通知。
你可以停止使用服务并依照隐私政策申请删除账号。我们可在你严重违反本条款、存在欺诈或安全风险、法律要求或继续提供服务不再合理可行时暂停或终止服务;在适用法律要求时,我们会提供通知或补救机会。
服务终止后,你的使用权终止。因用户违约、欺诈、滥用、拒付或法律要求导致的终止,其账号数据、未使用积分、已付款订阅和退款将依照本条款、退款政策、结账时适用的买方条款和强制性法律处理。
如 Didymoi 因自身运营原因永久停止相关付费服务,且用户不存在前述违约、欺诈或滥用,我们会在合理可行范围内提供继续使用期限、功能迁移、替代服务,或针对尚未履行部分提供适当补救;涉及款项退回时,由订单所示销售方或支付服务商按照其流程和适用法律处理。
11. 免责声明与责任限制
在适用法律允许的最大范围内,服务按现状和可用状态提供。我们不保证服务持续、无错误、完全准确或不会丢失数据,也不对间接、附带、特殊、惩罚性或后果性损失承担责任。
除适用法律另有强制规定外,我们对与你使用服务相关的累计责任上限为下列两者中的较高者:产生争议的相关订单实际支付金额,或争议发生前 12 个月内你为相关服务实际支付的金额。
本条款不排除或限制因欺诈、故意不当行为、依法不得限制的死亡或人身伤害,或者其他适用法律禁止排除或限制的责任。
12. 争议与可分割性
如发生争议,请先通过 Contact 页面列明的邮箱联系我们,我们会尝试在合理期限内友好解决。与 Paddle 或其他结账页面列明的销售方、转售商或 Merchant of Record 处理的交易有关的付款、税费、账单、取消、退款和争议,还适用该主体在结账页面、订单确认或收据中列明的买方条款及争议处理机制。
本条款不限制任何适用法律赋予消费者的强制性权利,也不限制任何一方依法向有管辖权的法院或机构寻求救济。如果本条款的任何部分被认定无效或不可执行,其余部分仍继续有效。
13. 条款更新与联系方式
我们可能因服务、支付安排、法律或安全要求更新本条款。更新后的条款会发布在本页面并标注新的生效日期;如变更会实质影响现有用户的权利或义务,我们会在适用法律要求的时间和方式内提供通知。

本条款、隐私政策、退款政策及相关法律通知可能提供不同语言版本。除适用法律强制要求采用其他版本外,如不同语言版本存在不一致,以英文版本为准;任何解释规则均不限制不可放弃的消费者或数据保护权利。
14. 客户数据与隐私义务
如你通过 API、OAuth 应用或其他集成方式代表组织处理终端用户数据,你应确保对该等数据具有合法来源、处理依据、必要授权和适当的隐私告知,并自行遵守适用的数据保护、内容安全和行业监管要求。
对于由你或你的组织决定处理目的和方式的终端用户数据,你或你的组织是相应的数据控制者;在适用情况下,Didymoi 仅为提供你请求的 API、OAuth 或集成功能而按照你的指示作为数据处理者或服务提供商处理该等数据。
如果适用法律要求在提交终端用户个人信息前签署数据处理协议(DPA)或其他书面安排,你应先联系我们确认是否可以提供并完成相应协议;在没有完成该等协议时,不得使用本服务处理依法必须受该等书面安排约束的个人信息。你应自行决定数据的备份、导出和删除;除非另有书面约定,我们不提供企业 SLA、数据删除证明或数据恢复保证。
如果我们合理认为客户数据、应用或使用方式存在安全、违法、侵权或滥用风险,我们可采取最小必要的限制、暂停、删除、保全证据或配合有权机关的措施,并在法律允许的范围内说明原因。
15. 保密、业务转移、第三方索赔与持续效力
双方对在使用服务过程中获得的非公开商业、技术、安全和账号信息承担合理保密义务;依法披露、为履行服务向必要处理方披露或信息已合法公开的除外。
如果 Didymoi 日后由新成立的公司、关联经营主体或本服务的合法继受方继续运营,我们可将本条款项下与业务相关的权利和义务转移给该主体,并依照适用法律提供通知。该转移不会减少你已经取得的强制性消费者权利。
在适用法律允许的范围内,如你代表企业使用服务,你应对因你的违法输入、侵害第三方权利或严重违反本条款而直接产生的第三方索赔承担责任;该责任不适用于由我们的过错造成的部分,也不扩大消费者依法承担的责任。
有关付款、退款、知识产权、保密、责任限制、争议和依法保留数据的条款,在服务终止后仍可在其性质和适用法律允许的范围内继续有效。
